    Investigating Obama: The Donofrio "Natural Born Citizen" Challenge



    Today, before the United States Supreme Court lies Leo Donofrio v. Nina Mitchell Wells, New Jersey Secretary of State. This suit was received by Justice Thomas and by the determination of the entire court, it is scheduled for conference on Friday December 5. This conference is held to decide what, if any, further steps should be taken. Only two of these steps would be to either intervene in the process of selecting the president, or to hear oral arguments.

    Essence of the case

    By this case Barack Obama, John McCain, and Roger Calero (of the Socialist Workers Party, on the New Jersey ballot) do not qualify as “natural born Citizens” under Article 2, Section 1, Clause 5 of the Constitution, which states the following:

    No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

    Standing


    Other cases against Obama's candidacy have been rejected by various courts, due to a private citizen's apparent lack of standing to sue a candidate. However, this case is an action against the Secretary of State of New Jersey and as such, has precedent, as Donofrio relates. He originally sought to motivate the Secretary to qualify or disqualify these three candidates on the New Jersey ballot. Donofrio also cites 2000's famous Florida case, Bush v. Gore, as precedent for a state case regarding a presidential election to be brought to the Supreme Court for emergency action.


    Merit: reasoning behind Donofrio v. Wells

    To interpret the U.S. Constitution with intellectual honesty, one must maintain the integrity of the meaning of the Constitution. That means interpreting the letter of the law: its words and phrases, based upon the immediate context of the Constitution itself, any explanations of the framers, traditional meaning inherited by the framers, and the generally accepted, legal meanings of words and phrases in use at the time of its drafting. Further, attention is to be paid to the spirit of the law, by understanding the purposes of the framers and the results they sought or sought to avoid, as they drafted each element of the Constitution.

    In view of these considerations, being a “natural born Citizen,” here requires meeting both of these two criteria: 1. citizenship must be passed on by the constitutionally pertinent principle of natural law, which assumes that citizenship is inherited from one’s father’s citizenship and, 2. citizenship must be granted by means of being born in the actual territory of the United States. Accordingly, to maintain the original intention of the Constitution's framers, a U.S. President is to be free of competing allegiances with other nations, from birth onward. To cite Donofrio's own words from his blog:

    The Framers wanted to make themselves eligible to be President, but they didn't want future generations to be Governed by a Commander In Chief who had split loyalty to another Country. The Framers were comfortable making an exception for themselves. They did, after all, create the Constitution. But they were not comfortable with the possibility of future generations of Presidents being born under the jurisdiction of Foreign Powers, especially Great Britain and its monarchy, who the Framers and Colonists fought so hard in the American Revolution to be free of.
    According to this case, Barack H. Obama II is not qualified, because his father, Barack H. Obama I, was a citizen of the United Kingdom as a Kenyan. Kenya was a British colony at the time of Obama II’s birth in 1961. This citizenship was conferred to Obama II by U.K. law. Further to this case is the apparent fact that Obama II became a citizen of Indonesia, when he lived there as a child with his mother and adoptive father, Lolo Soetoro. This would mean Obama's U.S. Citizenship status was revoked, since Indonesia had no dual-citizenship provision with the U.S.A.

    According to this case, John McCain is not qualified, because he was born in Panama or the Panama Canal Zone, which was a protectorate of the United States and has never been a territory of the Untied States, even though his parents were U.S. Citizens.

    According to this case, Roger Calero is not qualified, because he was born a citizen of Nicaragua, to foreign parents, on foreign soil. The mere fact that Roger Calero was on the ballot in five states indicates to the Supreme Court and the nation, that the process of qualifying a presidential candidate is broken and intervention is necessary.

    Merit: context, corroboration, and case law

    Corroborative to this case, the Constitution's Article 1, Section 8, Clause 10 states that a power of Congress is to "define and punish... offenses against the law of nations." The Law of Nations has been international law, which as documented by Emmerich de Vatel (1758) states, in Chapter XIX, paragraph 212, "The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights."
    Vatel follows with paragraph 215, in which he asserts, "It is asked whether the children born of citizens in a foreign country are citizens? The laws have decided this question in several countries, and their regulations must be followed.(59) By the law of nature alone, children follow the condition of their fathers, and enter into all their rights (§ 212); the place of birth produces no change in this particular, and cannot, of itself, furnish any reason for taking from a child what nature has given him; I say 'of itself,' for, civil or political laws may, for particular reasons, ordain otherwise."


    The chief framer of the related 14th Amendment of the Constitution, John A. Bingham corroborated this dual criteria stating, "every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen." An extensive analysis citing this is "Defining Natural-Born Citizen," by P.A. Madison, The Federalist Blog.


    Since then, the case of Perkins v. ELG, U.S. 325 (1939) provides precedent for requiring these two criteria, for one to be called a "native born citizen" (see, "The Law -- Perkins v. ELG," blog, The Betrayal).

    St. George Tucker, Justice of the Supreme Court of Virgina, wrote a version of the authoritative Blackstone's Commentaries: With Notes of Reference to the Constitution... which became a recognized resource for determining the framers' original intent. In his Volume 1 -- Appendix; Note D, he explained that the Article 2 "natural born Citizen" requirement was purposed to avoid competing allegiances:

    That provision in the constitution which requires that the president shall be a native-born citizen (unless he were a citizen of the United States when the constitution was adopted,) is a happy means of security against foreign influence, which, whereever it is capable of being exerted, is to he dreaded more than the plague. The admission of foreigners into our councils, consequently, cannot be too much guarded against; their total exclusion from a station to which foreign nations have been accustomed to, attach ideas of sovereign power, sacredness of character, and hereditary right, is a measure of the most consummate policy and wisdom. It was by means of foreign connections that the stadtholder of Holland, whose powers at first were probably not equal to those of a president of the United States, became a sovereign hereditary prince before the late revolution in that country. Nor is it with levity that I remark, that the very title of our first magistrate, in some measure exempts us from the danger of those calamities by which European nations are almost perpetually visited. The title of king, prince, emperor, or czar, without the smallest addition to his powers, would have rendered him a member of the fraternity of crowned heads: their common cause has more than once threatened the desolation of Europe. To have added a member to this sacred family in America, would have invited and perpetuated among us all the evils of Pandora's Box.
    Certainly, this applied to sons of subjects of the United Kingdom (and the fact that one such subject would travel abroad to declare himself a "Citizen of the World" before hundreds of thousands might also have provided relevant warning).

    Intended result of this case

    The Donofrio suit calls for a stay of the Dec. 15 Electoral College vote, until a constitutionally acceptable means is attained, of presenting the Electors a set of qualified candidates.

    During or after their Dec. 5 conference, the Supreme Court could decide upon a number of directions. Their next step may be revealed this very day, or on Monday, Dec. 8, or at some other time. A book could be written of the many potential outcomes -- and historians will write libraries about one set of results, in their hindsight.

    Leo Donofrio reports that numerous obstacles have been intentionally placed in the way of his petitioning the courts, in both New Jersey and at the Supreme Court. He also names public officials who have at times attempted to mislead him and by their treatment of his case, have obstructed his path to the Supreme Court. That is another story and not an undramatic one.

      Chinese property hunters to raid US

      Chinese bargain hunters are preparing to descend on American cities such as Los Angeles and San Francisco, where homeowners have suffered some of the steepest price falls in the US.

      SouFun, the biggest real estate website in China, is organising a trip next month to look at properties in California and possibly Nevada. Liu Jian, the company’s chief operating officer, said about 300 people had expressed interest in the idea in the three days since it was advertised, though the company would take only a small group on the first trip.

      Given the problems in the Chinese market now, many people have been asking us about taking a look at overseas markets, especially the US,” he said.

      The trip would focus on California, particularly San Francisco and Los Angeles, where big Chinese populations might make his clients more comfortable, but might also include Nevada.

      Restrictions on taking money out of China would be an obstacle, he added, but some potential investors had an overseas connection such as a foreign passport that would make it easier.

      Property professionals say there is considerable interest among wealthy Chinese, who often hold a high proportion of assets in property, in investing abroad.

      “The US market absolutely terrifies me,” said one Shanghai-based real estate executive. “However, there are plenty of people here who think this a great time for bottom-fishing.”

      There is opposition in China to SouFun’s plan. “Unless these people need a house in the US to live in, this is senseless,” said Yi Xianrong, a real estate expert at the Chinese Academy of Social Sciences. “A few years ago there was a lot of talk about investing in German real estate but most of the people who did so lost a lot of money.”

      SouFun, owned by Australia’s Telstra, provides information on property markets in more than 100 cities and has more than 40m registered users.

        Blagojevich: Senate seat a '******* valuable thing'
        Feds: Blagojevich 'has taken us to a truly new low' - Jonathan Martin and Carrie Budoff Brown - Politico.com

        Federal authorities arrested Illinois Gov. Rod Blagojevich Tuesday on charges that he brazenly conspired to sell or trade the Senate seat left vacant by President-elect Barack Obama to the highest bidder.

        Blagojevich also was charged with illegally threatening to withhold state assistance to Tribune Co., the owner of the Chicago Tribune, in the sale of Wrigley Field, according to a federal criminal complaint. In return for state assistance, Blagojevich allegedly wanted members of the paper's editorial board who had been critical of him fired.

        A 76-page FBI affidavit said the 51-year-old Democratic governor was intercepted on court-authorized wiretaps over the last month conspiring to sell or trade the vacant Senate seat for personal benefits for himself and his wife, Patti.

        The tapes reveal a two-term governor who no longer wants his job, badly wants cash and is determined to leverage a financial benefit out of his appointment powers.

        He also appears to think little of the president-elect, whom he calls a "motherf***er" at one point.

        “F**k him,” Blagjoveich says of Obama during a lengthy call with top aides and his wife recorded on November 10th, "For nothing? F**k him."

        The Blagojevich arrest is a problem for Barack Obama for two reasons. First, Blagojevich’s bagman Tony Rezko was Obama’s political sponsor.

        Second, Blagojevich’s intercepted comments speak volumes about the way political business is conducted in Illinois. Blagojevich certainly expected Obama to be a willing participant in the dealings over Obama’s Senate seat. Of course, Obama is pleading ignorance, but he is either part of the political culture that produced Blagojevich or he is not. I doubt Rezko had one set of ethical standards when Obama was in the room, and another when he was with Blagojevich.

        Obama already caught lying about his contact with Blagojevich. When asked what contact he'd had with the governor's office about his replacement in the Senate, President-elect Obama today said "I had no contact with the governor or his office and so we were not, I was not aware of what was happening."

        On November 23, Obama senior adviser David Axelrod said on Fox News that Obama had indeed spoken with Gov. Blagojevich about his successor:

        "I know he has talked to the governor and there are a whole range of names many of which have surfaced, and I think he has a fondness for a lot of them." (video)

        In another section of the complaint, Blagojevich expresses exasperation that Obama and his team aren't willing to offer him an inducement in exchange for appointing an aide, apparently Valerie Jarrett, to the Senate.

        Obama wanted his long-time associate, Valerie Jarrett, appointed to his vacant senate seat. Jarrett, in 1991, put Obama's then wife-to-be squarely in the offices of the man whose father had perfected the Democratic machine, Mayor Daly. After leaving City Hall, Jarrett went on to lead the Chicago Transit Authority. She recruited Michelle Obama to the transit agency's citizen advisory committee.

        One piece of speculation: Jarrett's abrupt withdrawal from consideration for the Senate seat suggests Obama's circle aware of the investigation.

        It is clear from the complaint that Obama refused to offer Blagojevich anything for appointing Jarrett:

        "Rod Blagojevich said he knows that the President-elect wants Senate Candidate 1 (Jarrett) for the Senate seat but 'they’re not willing to give me anything except appreciation. F*** them,'" says the complaint.

        So, Obama wanted Jarrett. Blagojevich wanted money.

        Is this investigation Obama's way to pay back Blagojevich? He does have a history of throwing people under his political bus.

        Obama and Blagojevich should both be in jail for this, but watch for Blagjoveich to spill the beans on the Obama/Rezko deals. This is just the beginning.

          Tribune Debt Plummets 94% In Wall Street Trading

          CHICAGO Tribune Co.'s publicly traded debt plummeted more than 94% on the New York Stock Exchange Monday afternoon as investors learned the Chicago media giant had filed for Chapter 11 bankruptcy protection.

          Tribune subordinated debentures due 2029 (NYSE: TXA) opened at $17.26 -- and plunged around 2 p.m. EST as word of the bankrutpcy petition broke. The debt TXA closed at $1.07, down $16.92. The volume of 635,256 was more than five time normal.

          NEW YORK (AP) -- Media conglomerate Tribune Co. has filed for bankruptcy protection.

          The owner of the Chicago Tribune, the Los Angeles Times, the Chicago Cubs and other properties has $13 billion in debt.

          Severe reductions in advertising this year because of the recession has put pressure on the company. Most of its debt comes from the complex transaction in which the company was taken private by real estate mogul Sam Zell last year.

          Although the next major principal payment isn't due until June, analysts say Tribune has been in danger of missing lender-imposed financial targets.

              Economy May Be Worse A Year From Now

              The US economy is likely to be in worse shape a year from now and will require aggressive government spending and intervention to stem the damage, economist Martin Feldstein told CNBC.

              Despite conservative leanings when it comes to government intervention in the financial markets, Feldstein said the current economic downturn is the worst since the end of World War II and mandates a different approach that even goes beyond the hundreds of billions the government already has poured into the system.

              "I think we'll be lucky if by this time next year we see the economy having hit the bottom and starting up, and that's still going to leave us at a very low level of economic activity even if the turn has come at that point," Feldstein said during a live interview. "But there's no guarantee that all of this put together is going to achieve that."

              Government will have to change the tax structure for capital gains and corporations while also exercising caution against inflation, added Feldstein, an economist at Harvard and president emeritus of the National Bureau of Economic Research.

              "We are facing an economic downturn that is worse than anything I have seen in the post-war period," Feldstein said. "American households have lost more than $10 trillion of net worth in the stock market and housing prices. They are cutting back on their spending...Where's the demand going to come from?"

              He also warned against one-off programs like the stimulus checks sent out this year, noting that 85 percent of those funds went either to savings or paying down debt, and said only "long-term structural changes" will solve the economy's many woes.

              But most important, he said, is helping out homeowners underwater on their mortgages. Homeowners owing more on their mortgages than their houses are worth pose a major problem, one which Feldstein said will require rewriting those loans.

              "That problem needs to be tackled," Feldstein said. "If that isn't tackled, then all this fiscal stimulus alone is not going to do the job."

                  It doesn't matter who they put in there they are all pawns. Obama, Bush, Clinton, Bush, Regan! Its sad that you have this obsession with Obama because it goes way past him! These people are all puppets man. Where to start...Why don't we start with getting rid of the federal reserve first! I sort of feel bad for this Obama guy, they have the perfect puppet to take the fall for what and will become of this country! Yet the Sheeple have no idea...

                  Can you tell me why you have such hatred tords this man HD? I can think of 10 other people that make this man look like a prize!

                  OH YEAH and I remember when I posted a email about Bush... Everyone said I wasn't patriotic and should leave this country if I didn't like him!.

                  I think its great you question the president but I feel you should have been question the Bush administration as well!

                  Just some food for thought! Not attacking you cause I do agree with you in many ways I just think a lot of folks who talk politics are hypocrites! The point the finger at one person and its usually the wrong one.

                  Oh yeah and now I remember why I don't get started talking about politics. Cause I just wasted 20 minutes of my day. When, what I think or do doesn't make a ****en different to anyone.... I could be capping the NBA.! I guess you can say I'm no different than the rest of the sheeple, put my head forward and keep walking and working for my owner, but I like to think I'm a little wiser.

                          Obama is Hiding a Radical Past!


                          Did you know that Barack Obama was affiliated with a leading national socialist party? Barack Obama didn’t include in his 2008 resume that he entered politics in the mid-1990s endorsed by Chicago’s leading socialists. This just keeps getting better and better. Barack Obama was an active participant in the 1990s, and a direct political beneficiary, of the Chicago New Party and, importantly, the Chicago DSA, a group of socialists affiliated with the Democratic Socialists of America.

                          Barack Obama attended and participated in meetings of the Chicago New Party and the Chicago DSA, the local affiliate of the Democratic Socialists of America.
                          Barack Obama sought the endorsement of the Chicago DSA which required rigorous scrutiny by the party’s Political Committee as well as Mr. Obama’s signature on a contract promising “a visible and active relationship with the NP.”
                          Barack Obama actively used the endorsement from the Chicago DSA.
                          Barack Obama won his DSA-endorsed and -backed campaign to secure his seat in the Illinois State Senate.
                          Barack Obama continued his involvement with the Chicago DSA — including directly asking the group to join “his task forces on Voter Education and Voter Registration” — and received their endorsements in subsequent campaigns.

                          Obama’s participation in and endorsement from the Chicago New Party and Chicago DSA, the local affiliate of the Democratic Socialists of America (which is the U.S. affiliate of the Socialist International) is quite clear:

                          According to the write-up on the July 1995 meeting of Chicago DSA and New Party membership, Barack Obama was one of about 50 people attending out of their then-300 member local group. Other documents below will demonstrate Barack Obama attended and participated in subsequent meetings.
                          The New Party rigorously evaluated its candidate endorsements and claimed “a winning ratio of 77 of 110 elections.” This was no passive endorsement.
                          Candidates must be approved via a NP political committee. Once approved, candidates must sign a contract with the NP. The contract mandates that they must have a visible and active relationship with the NP.—New Ground

                          Candidate Barack Obama participated as a panelist at the DSA-sponsored Town Meeting on February 25, 1996, entitled “Employment and Survival in Urban America”. As reported in New Ground,

                          Barack Obama observed that Martin Luther King’s March on Washington in the 1960s wasn’t simply about civil rights but demanded jobs as well. Now the issue is again coming to the front, but he wished the issue was on the Democratic agenda not just on Buchanan’s.

                          One of the themes that has emerged in Barack Obama’s campaign is “what does it take to create productive communities”, not just consumptive communities. It is an issue that joins some of the best instincts of the conservatives with the better instincts of the left. He felt the state government has three constructive roles to play.

                          The first is “human capital development”. By this he meant public education, welfare reform, and a “workforce preparation strategy”. Public education requires equality in funding. It’s not that money is the only solution to public education’s problems but it’s a start toward a solution. The current proposals for welfare reform are intended to eliminate welfare but it’s also true that the status quo is not tenable. A true welfare system would provide for medical care, child care and job training. While Barack Obama did not use this term, it sounded very much like the “social wage” approach used by many social democratic labor parties. By “workforce preparation strategy”, Barack Obama simply meant a coordinated, purposeful program of job training instead of the ad hoc, fragmented approach used by the State of Illinois today.

                          The state government can also play a role in redistribution, the allocation of wages and jobs. As Barack Obama noted, when someone gets paid $10 million to eliminate 4,000 jobs, the voters in his district know this is an issue of power not economics. The government can use as tools labor law reform, public works and contracts.

                          Obama subsequently secured his endorsement from the Chicago DSA
                          The local Democratic Socialists of America affiliate issued their Chicago DSA Endorsements in the March 19th Primary Election:
                          Barack Obama is running to gain the Democratic ballot line for Illinois Senate 13th District. The 13th District is Alice Palmer’s old district, encompassing parts of Hyde Park and South Shore.

                          Mr. Obama graduated from Columbia University and promptly went into community organizing for the Developing Communities Project in Roseland and Altgeld Gardens on the far south side of Chicago. He went on to Harvard University, where he was editor of the Harvard Law Review. He graduated with a law degree. In 1992, he was Director of Illinois Project Vote, a voter registration campaign that made Carol Moseley Braun’s election to the U.S. Senate much easier than it would have been. At present, he practices law in Judson Miner’s law firm and is President of the board of the Annenberg Challenge Grant which is distributing some $50 million in grants to public school reform efforts.

                          What best characterizes Barack Obama is a quote from an article in Illinois Issues, a retrospective look at his experience as a community organizer while he was completing his degree at Harvard:

                          “… community organizations and organizers are hampered by their own dogmas about the style and substance of organizing. Most practice … a ‘consumer advocacy’ approach, with a focus on wrestling services and resources from outside powers that be. Few are thinking of harnessing the internal productive capacities, both in terms of money and people, that already exist in communities.” (Illinois issues, September, 1988)

                          Luckily, Mr. Obama does not have any opposition in the primary. His opponents have all dropped out or were ruled off the ballot.

                          When Barack Obama challenged Bobby Rush for the 1st Congressional District in 2000, the Chicago DSA opted to recommend both:
                          For Congressman of the 1st Congressional District, the Executive Committee was faced with two very good candidates. As we are not making endorsements but merely recommendations, we felt no conflict in recommending both Bobby Rush and Barack Obama.

                          Bobby Rush was the incumbent Congressman. He was also a candidate for Mayor of Chicago in the last municipal elections, endorsed by Chicago DSA. While he hasn’t always been the ideal Congressman from a left perspective (being a cosponsor of the “NAFTA for Africa” bill, for example), he’s generally been quite good.                           Barak Obama is serving only his second term in the Illinois State Senate so he might be fairly charged with ambition, but the same might have be said of Bobby Rush when he ran against Congressman Charles Hayes. Obama also has put in time at the grass roots, working for five years as a community organizer in Harlem and in Chicago. When Obama participated in a 1996 UofC YDS Townhall Meeting on Economic Insecurity, much of what he had to say was well within the mainstream of European social democracy.

                          Conclusion
                          Barack Obama has a long-term and sustained relationship with the Chicago DSA, an affiliate of the Democratic Socialists of America, and with the Chicago New Party. He participated in multiple membership meetings and in DSA-sponsored events, repeatedly sought their endorsement. This does not answer all questions about Barack Obama’s past relationships with multiple socialist groups. What the media need to find out is this: Has Barack Obama broken his ties with them> If so, when and why?
